Construct Voucher Claim Terms and Conditions

1. Acceptance of Terms

By claiming, redeeming, using, or participating in any voucher, promotion, reward, campaign, or incentive offered through Construct ("Voucher"), you agree to be bound by these Terms and Conditions. If you do not agree, you should not claim or redeem any Voucher.

2. Definitions

Construct refers to the Construct platform, its owners, operators, affiliates, employees, and authorized representatives.

User refers to any voucher claimers using the Construct platform.

Business refers to any merchant or service provider offering Vouchers through Construct.

Voucher includes public vouchers, flash deals, subscription vouchers and credit vouchers.

3. Eligibility

Users must:

• Provide accurate and complete registration information.
• Meet any eligibility requirements specified for the Voucher.
• Comply with all applicable Malaysian laws.

Construct reserves the right to reject any claim that does not satisfy these requirements.

4. Voucher Availability

Vouchers are subject to:

• Availability.
• Quantity.
• While stocks last.
• Campaign period.
• Merchant participation.

Construct does not guarantee the availability of any Voucher.

5. Voucher Claim Process

Users may only claim a Voucher through official Construct channels. Construct reserves the right to verify:

• User identity.
• Account ownership.
• Device information.
• Location where applicable.
• Any other information necessary to prevent fraud.

6. Voucher Redemption

Each Voucher might contain specific redemption requirements including:

• Minimum purchase amount.
• Expiry date.
• Participating merchant.
• Product exclusions.
• One-time redemption limits.
• Other merchant-specific conditions.

Unused Vouchers will expire automatically after their validity period.

7. Non-Transferability

Unless expressly permitted:

• Vouchers cannot be sold.
• Vouchers cannot be exchanged for cash.
• Vouchers cannot be transferred.
• Vouchers cannot be gifted.
• Vouchers cannot be combined with unauthorized promotions.

8. Fraud Prevention

Construct may suspend, cancel, or permanently terminate any Voucher if there is reasonable suspicion of:

• Fake accounts.
• Multiple account abuse.
• Automated claims.
• Identity fraud.
• False information.
• System manipulation.
• Voucher farming.
• Unauthorized resale.
• Any activity considered abusive or fraudulent.

Construct's decision shall be final.

9. Verification

Construct may request:

• Identity Card (MyKad) verification.
• Passport verification.
• Business registration documents where applicable.
• Additional supporting documents.

Failure to provide verification may result in cancellation of the Voucher.

10. Cancellation and Modification

Construct reserves the right to:

• Modify any campaign.
• Amend Voucher values.
• Suspend promotions.
• Cancel any Voucher.
• End campaigns without prior notice where necessary.

11. Merchant Responsibility

Merchants are solely responsible for:

• Goods and services provided.
• Product quality.
• Delivery.
• Warranties.
• Customer service.
• Refunds where applicable.

Construct acts only as the platform facilitating Voucher distribution.

12. Limitation of Liability

To the fullest extent permitted by Malaysian law, Construct shall not be liable for:

• Merchant disputes.
• Loss of Voucher due to user negligence.
• Technical failures.
• Internet interruptions.
• Device incompatibility.
• Indirect, incidental, or consequential losses.

13. Intellectual Property

All trademarks, logos, graphics, software, content, and branding associated with Construct remain the exclusive property of Construct or its licensors. Users shall not reproduce or misuse any intellectual property without written permission.

14. Governing Law

These Terms and Conditions shall be governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

15. Amendments

Construct may revise these Terms and Conditions at any time. Continued use of the platform or any Voucher after publication of revised Terms constitutes acceptance of the updated Terms.

16. Data Governance and Personal Data Protection

Construct is committed to protecting users' personal data in accordance with the Personal Data Protection Act 2010 (PDPA), the Personal Data Protection (Amendment) Act 2024, and all applicable Malaysian privacy laws.

By participating in any Voucher campaign, users consent to Construct collecting, processing, storing, using, and disclosing personal data for purposes including:

• Identity verification.
• Voucher eligibility assessment.
• Fraud detection and prevention.
• Customer support.
• Campaign administration.
• Legal and regulatory compliance.
• Security monitoring.
• Statistical analysis.
• Service improvement.

Construct may share personal data with authorized merchants, payment providers, verification providers, regulators, government authorities, and service providers where necessary and permitted by law.

Construct implements reasonable administrative, technical, and organisational safeguards to protect personal data against unauthorised access, disclosure, alteration, misuse, or loss.

Users have the right, subject to applicable law, to request access to, correction of, or withdrawal of consent relating to their personal data. Such requests may be made through Construct's official customer support channels.

Where identity verification is required, users acknowledge that Construct may retain verification records for the period required under applicable laws, regulatory obligations, fraud prevention requirements, and legitimate business purposes.

Users are responsible for ensuring that all information provided is accurate, current, and complete. Construct reserves the right to suspend or terminate Voucher eligibility where false, misleading, or fraudulent information is submitted.
